New York state could adopt its own version of net neutrality under legislation being announced by state lawmakers.

A proposal by Assemblywoman Patricia Fahy of Albany and Sen. David Carlucci of Clarkstown, both Democrats, would prohibit companies like AT&T, Comcast and Verizon from interfering with internet traffic to favor certain sites or types of consumers.

A federal net neutrality rule was recently repealed by the Federal Communications Commission. Several states are now looking at creating their own rules. A group of attorneys general for 21 states and the District of Columbia has sued to block the repeal. New York attorney general Eric Schneiderman is leading the suit.

New York state will also require all internet providers to observe net neutrality or risk losing their eligibility for state contracts.

Democratic Gov. Andrew Cuomo enacted the policy through executive order Wednesday, following a similar move by Montana Gov. Steve Bullock on Monday. Several states are considering how to respond after the Federal Communications Commission last month repealed its net neutrality policy.

New York state legislators had pushed for the new policy as a way to protect consumers by using the state's lucrative information technology contracts as leverage over internet companies.
